Why Do You Need a J1 Visa Waiver?
J1 Visa holders are required to go back to their home country for at least two years after completing their exchange visitor program. This is known as the 2-year home residency requirement, but it doesn’t always have to happen.
A J-1 visa holder can apply for a waiver to allow them to stay in the country.

No Objection Waiver
What is a No Objection Waiver? The J-1 holder will need to contact the consular section of their home country’s embassy in Washington, D.C., and request a “no objection” statement to be forwarded to the Department of State on their behalf. The J-1 holder’s government must state that it has no objection to the applicant not returning to your home country to satisfy the two-year foreign residence requirement of Section 212(e) of the Immigration and Nationality Act, and remaining in the United States if the applicant choose to do so. This option is not available to physicians.
Hardship Waiver
A hardship waiver is based on two steps: 1. Establish that the applicant’s US Citizen / Legal Permanent Resident spouse or child would experience exceptional hardship if he or she resided in the home country for two years with the applicant and 2. Establish that the applicant’s US Citizen / Legal Permanent Resident spouse or child would suffer exceptional hardship if he or she remained in the United States during the period the applicant resides abroad. It should be noted that simple being separated for two years will not meet the standard for USCIS. Our firm can guide you on the ways to establish these things when filing for a hardship waiver.
Persecution Waiver
Persecution waivers may be filed if an individual fears that they will be persecuted in their home country on account of race, religion, or political opinion. Our firm can guide you on the ways to establish these things when filing for a persecution waiver.
Interested Government Agency Waiver
Applicants who work for a U.S. government agency (i.e. National Institute of Health, Department of Defense, etc.) may request that the agency request the waiver of the two-year home residency requirement on their behalf. We will coordinate and assist in this process.

Does you help obtain J-1 visas for clients?
Unfortunately, we only work with individuals who already have a J-1 visa and are subject to the 212(e) home residency requirement ("2 year rule").
How do I know if you need a waiver?
Please check your DS2019 form and/or J-1 visa stamp in your passport. There will either be a box checked that you are subject to 212(e) or it will state it on your visa.
How long does a J-1 waiver take to obtain?
The timeline varies depending on which route you choose to take but generally budgeting for at least 4-6 months is recommended.
If you obtain a J-1 waiver can I stay in the country? No, you will need some sort of underlying visa or green card application. You should not stay in the U.S. just because you obtain a waiver.
Can you apply for a J-1 waiver if I am out of status?
Generally, if you are out of status we recommend you leaving the US immediately and applying for a waiver from abroad but there are some exceptions. Please contact us to figure out the best route.
Can you help me find a job after obtaining a J-1 waiver?
Unfortunately, we are unable to provide job placement however we are happy to help process your immigration paperwork once you find a qualifying job.
